THESE TERMS OF USE GOVERN YOUR USE OF THE WEBSITE AND THE Premium Free TV PLATFORM SERVICES.
BY REGISTERING TO ACCESS AND USE THE SERVICES OR USING THE WEBSITE YOU CONFIRM THAT YOU HAVE READ, UNDERSTAND AND AGREE TO THESE TERMS OF USE. IN THE EVENT THAT YOU ARE REPRESENTING A COMPANY OR OTHER ENTITY, YOU REPRESENT TO Premium Free TV THAT YOU ARE DULY AUTHORISED TO DO SO AND THAT THESE TERMS OF USE CONSTITUTE VALID AND BINDING OBLIGATIONS ON SUCH COMPANY OR ENTITY, IN WHICH CASE “YOU” AND “YOUR” SHALL REFER TO SUCH COMPANY OR ENTITY
IF YOU DO NOT HAVE SUCH AUTHORITY OR DO NOT AGREE WITH THESE TERMS OF USE, YOU MAY NOT ACCESS THE SERVICES. YOUR ATTENTION IS SPECIFICALLY DRAWN TO CLAUSES 11 AND 12 THAT LIMIT THE RISK AND LIABILITY OF Premium Free TV, AND IMPOSE AN OBLIGATION ON YOU TO INDEMNIFY Premium Free TV AND OTHER PARTIES.
1 Definitions
1.1 “Premium Free TV” refers to Premium Free TV Proprietary Limited, a private company duly registered in terms of the laws of the Republic of South Africa with registration number 2020/099054/07 who owns and runs the Premium Free TV platform.
1.2 “Account” refers to an account created by you on the Website and/or App, if you have elected to do so.
1.3 “App” refers to the Premium Free TV mobile application;
1.4 “Business Day” refers to any day which is not a Saturday, Sunday or official public holiday in the Republic of South Africa.
1.5 “Cookies” refers to small pieces of information stored on your hard drive which help you to navigate the Website as easily as possible.
1.6 “Content” refers to horseracing and other related audio-visual content made available by Premium Free TV by way of the Services.
1.7 “Devices” refers to internet-connected televisions, computers, tablets and mobile devices.
1.8 “Personal Information” refers to personal information as defined in the Protection of Personal Information Act, 4 of 2012.
1.9 “Privacy Policy” refers to Premium Free TV’s privacy policy, a copy of which is available on the Website.
1.10 “Services” refers to the on demand streaming video services provided by Premium Free TV which enables customers or users to access the content over the internet via the Website, the App and/or any other medium used by Premium Free TV from time to time.
1.11 “These/the Terms of Use” refers to these terms of use.
1.12 “Website” refers to, and includes any part or element of, watch.premiumfree.tv and any sub-site or other website owned or used by Premium Free TV.
2 Accessing the service
2.1 In order to use the Services, you will be required to visit watch.premiumfree.tv or download and launch the App on a supported device.
2.2 Registration is optional for users who solely wish to stream content; however, for those desiring to utilize the platform's full functionality, such as downloading content, creating playlists, or adding races to favourites, registration is mandatory. To register your Account, you will need to create a profile by submitting your email address and creating a password.
2.3 You confirm that all of the information that you provide for purposes of clause 2.2 above is accurate and complete in all respects and you undertake to notify Premium Free TV of any changes to such information by editing your Account information timeously.
2.4 Once your Account has been successfully created, you will receive an e-mail confirming your registration.
2.5 Your Account is for your personal use, and you shall be responsible for securing your Account login details. You will not, save as contemplated in these Terms of Use, share your Account login details with any third party or permit any third party to gain access to your Account.
2.6 If the security or confidentiality of your Account is compromised or you believe that a third party has gained unauthorised access to your Account, you will notify Premium Free TV in writing and ensure that the password for that Account is changed immediately.
3 Use of the Services
3.1 The Services are available for private, non-commercial use in the Territory only. You may only access and use the Services via your Device(s) in the Territory. The Content that will be available to you may vary by geographic location and change over time.
3.2 You may not sell or levy any charge for watching the Content or using any part of the Services or show any part of the Content in public to an audience, even if no charge is levied therefor. You will require access to internet in order to use the Services and you will be liable for all costs associated therewith, including but not limited to data and connection costs. These costs are not included in the Services, and you are encouraged to check with your internet provider for information on such costs.
3.3 Users who choose to register and log in, as well as those who opt not to do so, enjoy unlimited access to Premium Free TV Services and content on any number of devices. Additionally, there are no restrictions on concurrent streams.
3.4 The quality of the display of the Content may vary depending on, amongst others, the Device you use to access the Services, your location, the speed and type of your internet connection and the format in which the Content is available. Not all Content will be available in high definition.
3.5 You undertake to:
3.5.1 only use the Services in accordance with these Terms of Use, for the purposes for which they are intended and for no other use;
3.5.2 not reverse engineer, decompile or disassemble the Website, the App, the Services and/or the Content or attempt to do so;
3.5.3 not attempt to gain unauthorised access to the Services or related systems or networks;
3.5.4 use any scraper or other automated means to access the Services or the Content;
3.5.5 not copy the Website, the App, the Services and/or the Content or any part, function or feature thereof;
3.5.6 not circumvent, remove, alter, deactivate, degrade or thwart any of the protections in respect of the Website, the App, the Services, the Content and/or your Account, including VPN blockers or programmes having the same or similar effect; and
3.5.7 not use any code, software or device to interfere or attempt to manipulate the Website, the App, the Services, the Content and/or your Account or any part, function or feature thereof and/or interfere with their proper working.
4 Premium Free TV’s Responsibilities
4.1 Premium Free TV shall use reasonable endeavours to ensure that the Services are available at all times. However, you acknowledge that the Services may be interrupted from time to time due to events or circumstances beyond Premium Free TV’s control, including but not limited to:
4.1.1 maintenance or repairs, including emergency maintenance or repairs; and
4.1.2 outages and/or interruptions in communications, data networks or third party services, including but not limited to infrastructure failures, power failures, and failures caused by factors beyond Premium Free TV’s control (e.g., failure of third-party service providers, force majeure, etc.).
4.2 Premium Free TV does not warrant that the Services will be uninterrupted or error-free.
4.3 Premium Free TV reserves the right to suspend or withdraw access to the Services, the Website or the App at any time, with or without notice, for operational reasons, including but not limited to maintenance, repairs, system upgrades or the introduction of new facilities or services.
4.4 Premium Free TV reserves the right to make changes to the Content offered as part of the Services and/or the Website or the App at any time without notice to you.
4.5 Premium Free TV will not be liable to you or any third party for any interruption, suspension, withdrawal or modification of the Services or the Content.
5 Intellectual Property Rights
5.1 All intellectual property rights, including but not limited to copyright, trademarks, service marks, trade names, and any other rights in any content, software, or other material available through the Services, belong to Premium Free TV or its licensors. Nothing in these Terms of Use shall be construed as granting you any rights to use such intellectual property.
6 Termination
6.1 Premium Free TV reserves the right to suspend or terminate your access to the Services or your Account at any time if you breach any of these Terms of Use or if Premium Free TV reasonably believes that you have done so.
6.2 You may terminate your Account by contacting Premium Free TV in writing or through the appropriate interface in the App or on the Website.
7 Limitation of Liability
7.1 Premium Free TV shall not be liable for any direct, indirect, consequential or incidental damages, or any loss of profits, data, or business arising out of or in connection with the use of the Services or the Content.
8 Governing Law
8.1 These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the South African courts.
